Terms of Use

Effective September 22, 2026

These Terms of Use govern your use of the Floaty iOS app, this website, and related services. The service is provided under the Floaty name. By using Floaty, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.

Eligibility

You must be at least 13 years old, or older if the law where you live requires a higher minimum age for this type of service. By using Floaty, you confirm that you meet the applicable minimum age and can agree to these Terms.

The service

Floaty provides cruise planning and travel utility features, which may include saved itineraries, ship information, maps, port weather, notifications, Live Activities, Smart Return reminders, and issue reporting. Features may change, be limited, or become unavailable without notice.

Ship positions, itineraries, port times, weather, maps, traffic estimates, and other travel information can be delayed, incomplete, inaccurate, interrupted, or unavailable. Floaty may rely on information from cruise lines, public sources, Apple services, network providers, and other third parties.

Not safety or navigation advice: Floaty is not a navigation system, emergency service, official cruise-line source, or substitute for a ship’s crew, port authority, current charts, GPS, weather alerts, or your own judgment. Do not use Floaty for navigation, maneuvering, emergency decisions, evacuation, medical decisions, or any situation where inaccurate or delayed information could cause injury, loss, or damage. Verify important information with the cruise line, crew, port authority, and current official sources.

Accounts and your information

Floaty does not currently require a separate Floaty account. You are responsible for the Apple Account, device, iCloud settings, permissions, and other services you use with Floaty. You are also responsible for reviewing information before relying on it and for keeping your device and accounts secure.

If you submit an issue report or contact support, you give Floaty permission to use the information you provide to respond, investigate, secure the service, and improve the product. Do not submit passwords, payment card numbers, government identifiers, or information about another person unless it is necessary and you are authorized to provide it.

Acceptable use

You may use Floaty only for lawful personal purposes. You may not:

  • Use Floaty to make navigation, emergency, or safety decisions.
  • Interfere with, overload, probe, or circumvent security controls.
  • Reverse engineer, decompile, or attempt to extract source code except where applicable law permits it.
  • Scrape, copy, resell, or republish the service or its data without permission.
  • Submit malicious, unlawful, fraudulent, or abusive content.
  • Use Floaty to violate the rights, privacy, or safety of another person.

Paid features and Apple billing

Floaty may offer a yearly auto-renewing Floaty Plus subscription and a non-renewing Voyage Pass that lasts 14 days. Product names, features, availability, and duration may change. Apple will show the current price, currency, billing period, and renewal terms before you complete a purchase. No product price is stated in these Terms.

The yearly subscription renews automatically unless you cancel it through your Apple Account subscription settings before the renewal date. The Voyage Pass is a one-time purchase and does not renew. Apple processes payment, billing, cancellation, and refunds, subject to Apple’s terms and applicable law. Floaty does not control Apple’s billing systems.

Paid features are licensed for the Apple Account and device use allowed by Apple. Access may depend on a valid transaction, supported software, network availability, and the feature’s continued availability.

Ownership and license

Floaty and its original software, design, text, trademarks, and service materials are owned by Floaty or its licensors. Subject to these Terms, Floaty grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the app and service for lawful personal use. No ownership rights are transferred to you.

Third-party names, cruise-line information, maps, weather data, and other third-party materials belong to their respective owners and may be subject to additional terms.

Third-party services

Floaty may depend on Apple services, internet access, hosting providers, data providers, cruise-line systems, mapping services, weather services, and notification infrastructure. Those services are outside Floaty’s control. Their availability, accuracy, terms, and privacy practices are governed by the applicable provider.

Availability and changes

We may modify, suspend, or discontinue any feature or the service. We may restrict access when reasonably necessary to protect the service, users, or third parties, or to comply with law. We are not responsible for outages or failures caused by networks, devices, permissions, Apple services, cruise lines, weather providers, or other third parties.

Disclaimers

To the maximum extent permitted by law, Floaty is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not promise that the service will be accurate, uninterrupted, secure, timely, compatible with every device, or available in every location. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

Limits of liability

To the maximum extent permitted by law, Floaty and its operators, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, business, travel opportunities, or goodwill arising from or related to your use of the service. This includes reliance on delayed, inaccurate, incomplete, or unavailable information.

To the maximum extent permitted by law, Floaty’s total liability for claims related to the service will be limited to the amount you paid for the affected service during the 12 months before the event giving rise to the claim. This limit does not apply where the law does not permit it, including rights that cannot be waived by consumers.

Indemnity

To the extent permitted by law, you agree to protect Floaty and its operators, licensors, and service providers from claims, losses, and expenses arising from your unlawful use of the service, your violation of these Terms, or your violation of another person’s rights. This section does not require you to indemnify anyone for their own unlawful conduct.

Applicable law and consumer rights

These Terms are subject to applicable law. If you are a consumer, you keep any mandatory protections, rights, and remedies available where you live. Nothing in these Terms limits those non-waivable rights.

Apple terms

If you download or use Floaty through Apple’s App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple is not responsible for Floaty’s maintenance, support, content, warranties, or claims relating to the service. Your use of the App Store is also subject to Apple’s terms.

Changes to these Terms

We may update these Terms as Floaty changes. The updated version will be posted at this URL with a new effective date. Your continued use of Floaty after an update means you accept the updated Terms, except where applicable law requires a different process.
